The book updates the six major themes which were already included in the book "De aanbestedende overheid & Capita Selecta met focus op rechtspraak” (2020) with new case law:
- errors and ambiguities in the technical specifications of the tender documents;
- contacts and notification obligations in open and restricted procedures;
- exclusion and selection;
- the price investigation and abnormal prices;
- the award of the tender;
- damages following an illegal award.
A seventh important theme was added: the regularity of the tenders, based on the thoroughly amended rules of the Royal Decree of 18 April 2017 and the subsequent updated case law of the Council of State. For each theme, after discussing the applicable rules, the case law is explained exhaustively. More than 1,000 judgments pass the review.
