Lufthansa: a new era for State aid enforcement?

With its judgment of 21 November 2013 in the Lufthansa case, the Court of Justice reinforces, in the particular case where aid is the subject of a decision to initiate the formal investigation procedure under Article 108(2) TFEU, the duty for the national courts to take all necessary measures when confronted with a violation of the standstill obligation laid down in Article 108(3) TFEU.
