By this contractual method, parties agree to refer to a third party or expert who will make a binding decision under a contract. Parties undertake not to challenge the expert’s report. This binding character will also be respected by the judge in case the matter is later referred to court.
The advantage of a third party decision is to offer a fast and informal solution, less expensive than arbitration and without the uncertainties of court proceedings. This technique enables to complete or modify contracts, to take a decision regarding factual matters, or to resolve a legal conflict.
