& DE BANDT has recently won an historical case before the General Court of the European Union.
In its decision of 4 December 2014, the President of the Court has adopted a new approach and ordered to suspend the decision from a European institution to award an insurance contract to a broker. The unsuccessful tenderer is no longer required to demonstrate an irreparable harm if it can prove the sufficiently manifest and serious nature of the illegalities, the occurrence or continuation of which must be prevented as soon as possible, unless the balance of interests involved opposes doing so. According to the President, such a requirement of irreparable harm would be excessive and prevent an effective judicial protection in relation to public procurement.
