De Europese Handhavingsrichtlijn 2004/48 laat rechthebbenden toe om maatregelen te bekomen tegen tussenpersonen wiens diensten worden gebruikt om een inbreuk te plegen op hun intellectuele eigendomsrechten. Een blik op de voorbije tien jaar leert dat rechthebbenden dankbaar gebruik maken van deze mogelijkheid, zowel ten aanzien van online als offline tussenpersonen. In deze bijdrage gaan we nader in op de artikelen 8, 9 en 11 van de Handhavingsrichtlijn en hun omzetting in Belgisch recht. Aan de hand van de Europese en nationale rechtspraak illustreren we de ruime uitlegging die aan het begrip tussenpersoon wordt gegeven en besteden we aandacht aan de strekking van de maatregelen die jegens tussenpersonen kunnen worden bevolen.
La « Directive Enforcement » 2004/48 permet aux ayants-droit d’obtenir une injonction à l’encontre des intermédiaires dont les services sont utilisés par un tiers pour porter atteinte à un droit de propriété intellectuelle. Un aperçu des dix dernières années enseigne que les titulaires de droits font souvent usage de cette possibilité, tant à l’encontre des intermédiaires en ligne que des intermédiaires hors ligne. Dans cette contribution, nous analysons les articles 8, 9 et 11 de ladite Directive ainsi que leur transposition en droit belge. A l’aide d’exemples tirés de la jurisprudence européenne et nationale, nous illustrons l’interprétation large conférée à la notion d’intermédiaire et nous concentrons sur la portée des mesures pouvant être imposées à ces derniers.
The EU Enforcement Directive 2004/48 enables rightholders to apply for an injunction against intermediaries whose services are used by a third party to infringe an intellectual property right. A look at the past ten years shows that rightholders often make use of this possibility, both with regard to online and offline intermediaries. In this contribution we discuss Articles 8, 9 and 11 of the Enforcement Directive and their transposition into Belgian law. Using examples from European and national case law, we illustrate the broad interpretation of the notion of intermediary and we focus on the scope of the measures that can be imposed upon intermediaries.
